1. Agreement
By downloading, purchasing, or using BrainSober, you agree to these Terms and our Privacy Policy. If you do not agree, do not use BrainSober. The service is operated by BrainSober.
2. What BrainSober provides
BrainSober is a digital-wellbeing and productivity tool that helps you configure Screen Time protections, visualize a personal attention budget, complete offline reset activities, earn Focus Credits, and review progress. Features depend on compatible Apple devices, iOS permissions, and Apple’s Family Controls, Device Activity, and Managed Settings frameworks.
BrainSober is not medical care, mental-health treatment, or a substitute for professional advice. It does not guarantee a particular reduction in screen time, productivity result, or health outcome.
3. Eligibility and responsible use
You must be legally able to accept these Terms in your country. If local law requires permission from a parent or guardian, you may use BrainSober only with that permission. You are responsible for the device, Apple Account, settings, and activities used with BrainSober.
Do not misuse the service, interfere with its operation, attempt unauthorized access, reverse engineer it except where applicable law expressly permits, or use it in a way that violates law or another person’s rights.
4. Subscriptions, billing, and cancellation
- Available plans, prices, billing periods, trials, and promotional offers are shown in the App Store purchase screen before you confirm a purchase.
- Payment is charged to your Apple Account when the purchase is confirmed.
- Auto-renewable subscriptions renew unless cancelled at least 24 hours before the end of the current period. Apple may charge the renewal within 24 hours before the period ends.
- You can manage or cancel a subscription in your Apple Account subscription settings. Deleting the app does not cancel a subscription.
- Refund requests and billing disputes are handled by Apple under Apple’s policies and any mandatory rights that apply where you live.
- If a purchase is not recognized, use Restore Purchases in BrainSober while signed in to the Apple Account used for the purchase.
We may change prices or plans prospectively as permitted by Apple and applicable law. Apple will provide any notice or consent flow required for subscription price changes.
5. Apple terms
Your license to the iOS app is also subject to Apple’s Standard Licensed Application End User License Agreement. Apple is not responsible for BrainSober’s support, maintenance, or claims except as required under that agreement or applicable law.
6. Availability and Screen Time limitations
Screen Time behavior depends on iOS, device configuration, authorization status, schedules, system limits, and Apple services outside our control. Thresholds, shields, notifications, and temporary unlocks may be delayed, interrupted, or unavailable. Do not rely on BrainSober for emergencies, safety-critical restrictions, parental supervision, or any situation where failure could cause harm.
We may modify, suspend, or discontinue features to improve the product, comply with law or platform rules, address security issues, or respond to technical constraints. When practical, we will avoid materially reducing paid functionality during an active subscription without notice.
7. Intellectual property
BrainSober, including its software, design, text, graphics, mascot, trademarks, and other content, is owned by BrainSober or its licensors and is protected by intellectual-property law. Subject to these Terms and Apple’s license terms, you receive a personal, limited, non-exclusive, non-transferable, revocable license to use the app for its intended purpose.
8. Feedback
If you send suggestions or feedback, you allow us to use them without restriction or compensation, while you retain ownership of any rights you already hold. Do not submit confidential information through feedback channels.
9. Suspension and termination
You may stop using BrainSober at any time. We may suspend or terminate access when reasonably necessary to address misuse, security, legal, or platform requirements. Subscription cancellation and refunds remain governed by Apple and applicable law.
10. Disclaimers
To the maximum extent permitted by law, BrainSober is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not disclaim warranties, guarantees, or remedies that cannot legally be excluded in your country.
11. Limitation of liability
To the maximum extent permitted by law, BrainSober will not be liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost data, or loss arising from reliance on Screen Time restrictions. Where liability cannot be excluded, it is limited only to the extent permitted by applicable law. Nothing in these Terms limits liability for fraud, intentional misconduct, death or personal injury caused by negligence, or mandatory consumer rights.
12. Governing terms and consumer rights
These Terms are governed by the laws applicable at the operator’s principal place of business, without depriving consumers of mandatory protections or dispute forums available where they live. If a provision is unenforceable, the remaining provisions continue to apply. These Terms, Apple’s applicable license terms, and the Privacy Policy form the agreement for BrainSober.
13. Changes and contact
We may update these Terms prospectively. Material changes will be communicated through the app, website, or another reasonable channel. Continued use after the effective date means you accept the revised Terms where permitted by law. Contact support@brainsober.app with questions.
